he has heard that this ordinance is not in any way directed at the mikeebo landfilll, and yet that landfill has been referenced numerous times in this discussion. he said he believes the ordinance before the commission is directed at future proposed landfills. mr. brown asked mr. washington if this is a good ordinance. mr. washington said that what commissioner mcculloch envisioned, and what she is asking the commission to approve, is a device whereby the parish has some type of authority insofar as where landfills can or cannot be sited, but not to be a part of the operational regulatory process. based on the parish's home rule form of government, the parish can do anything that is not inconsistent with the louisiana constitution or denied by general law. he said he believes the parish can make a good faith argument that the parish can actually site facilities such as this. he conceded, however, that the state can make a counter argument. ultimately the ordinance would, if contested, have to be tested before a court for a final ruling, he said. this is outside the parish's traditional zoning authority, he said, and therefore a somewhat new area of law that would test the limits of home rule government. such a case would probably generate state-wide interest, with other parishes being interested in what they can and cannot do in such instances and play poker superstars.
